Mike Driver Magic: Terms & Conditions
- Booking and Payment:
- A deposit is required in order to confirm, and secure, a provisional booking that has initially been made, by email, text, or phone call, for example.
- The deposit is non-refundable.
- Accepted payment methods: BACS, cheque,
- The key information about the booking will be recorded on a Booking Form. This will also incorporate the relevant invoices.
- The details in the Booking Form are an agreement ( a contract) between the Client, and Mike Driver Magic for the provision of close up magic entertainment at the client’s event.
- The receipt of the Booking Form/Invoice and the subsequent payment of the deposit indicates that the client accepts the accuracy of the information summarised, and will provide any additional information requested in order to fully meet the Terms & Conditions.

- The deposit requested will be 35% of the full fee. For bookings made close to the event date, the full fee may be required in advance.
Payment Schedule:
- The Deposit is due within 7 days of the provisional agreement, unless otherwise
agreed, in writing, by Mike Driver Magic.
- The Balance is due to be paid ON THE DAY, IN CASH please.
- Alternatively, the balance can be paid in advance by BACS. Some clients
prefer this, as they do not wish to carry cash, on the day of their special event.
- Cancellation:
Client Cancellation, charges applying:
- The initial deposit is non-refundable
- If a client cancels more than 60 days before the date of the event then there will
be no further cancellation charge.
- Cancellation made 30-59 days prior to the Event Date: 50% of Total Invoice
- Cancellation made 15-29 days prior to the Event Date: 60% of Total Invoice
- Cancellation made less than 15 days prior to the Event Date: 100% of Total Invoice
Magician Cancellation:
In the 20+ years over which I have entertained as a close up magician, I have only had to cancel on one occasion, through illness. I am highly professional & reliable.
There are possible situations where I might need to cancel:
- Unforeseen circumstances such as fire, other casualty, strike, act of God, accident when travelling, or other cause beyond my control including illness,
In the very unlikely event that I did need to cancel then I would take the following actions:
- Promptly notify the clients (as soon as possible).
- Issue a full refund of the deposit, and any other monies already paid upfront, by the
client.
- Take immediate action to try and help identify a suitable replacement magician for the
event.
- I shall have no further liability to the Client with respect to the Contract.
- Liability and Insurance:
Public Liability Insurance:
- I am a fully paid up member of Equity and have Public Liability Insurance with cover of
£10 million
Client Responsibility:
- The client should agree not to ask Mike Driver Magic to undertake any actions which
are not covered by the insurance.
Limitation of Liability:
- If, for some reason, the venue provided by the Client is unable to accommodate the
act e.g. strike action, fire, natural disaster, Act of God etc, then the Client will be liable
for cancellation charges as given above in section 2.
- Performance and Event:
Venue Requirements:
- The lighting must be at a suitable level such that guests at the event can clearly see the props being used e.g. playing cards, banknotes, coins etc
- Low level background music is fine, but loud music makes it very difficult for the magician to communicate with the audience and is unsuitable when the magician is performing.
- When entertaining in-between courses, during a meal then there must be adequate space for the magician to place small items on the table.
Audience Size:
- Clearly, the larger the number of guests, the more time will be required for Mike Driver Magic to entertain them
- The following is a rough guide:
– 50-60 guests: 2 hours
– 90-100 guests: 3 hours
- For very large functions it is useful to have a team of 2 or even 3, magicians
- General Terms:
The terms and conditions, as applied to the specific event for which Mike Driver Magic has been booked, constitute the entire agreement between the parties.
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
If any part of the agreement is found to be invalid, the rest remains in effect.
Modifications:
Any modifications to the contract must be made in writing, and must be agreed by both the client and Mike Driver Magic.
